Poisoning at Work Compensation Claims
Many people work with chemicals as part of their day to day life with no ill effect. This may vary from pharmaceutical work and chemical engineering where hazardous substances are handled in large quantities, to the hair and beauty industry where the use of chemicals is prevalent but may not be regarded by many as dangerous.
The reality is that the handling of any chemicals should be approached with caution and they should only be used in accordance with the recognised and approved guidelines.
The Control of Substances Hazardous to Health Regulations (COSHH) state that every employer has an obligation to prevent employees being exposed to substances which are hazardous to their health. This will include substances which are handled directly and others where exposure could occur through vapour or airborne particles.
Where work is undertaken with hazardous substances an employer must undertake a risk assessment addressing a number of issues including:
- The hazardous properties of each substance;
- The measures necessary to prevent exposure;
- The information and training to be provided;
- Any personal protective equipment that is deemed necessary.
Exposure levels must also be monitored on a regular basis and there should be a system of health surveillance for all employees who face the risk of potential exposure. The use and effectiveness of the control measures to be adopted and the personal protective equipment used should also be reviewed on a regular basis. Further information regarding the measures employers should take can be found on the HSE website.
