Anyone injured under the age of 18 can still pursue a personal injury compensation claim although they cannot do so in their own name. Instead an adult must pursue the action on their behalf as a litigation friend.
The litigation friend will normally be a parent or guardian and may even have been involved in the accident themselves. This is providing there is no question of the adult being responsible for the accident.
The claim will be pursued in exactly the same way as any other accident or personal injury compensation claim although some important distinctions exist:-
- The normal 3 year time limit does not apply;
- Where the accident involves a particularly young child, specialist medical advice may be required to consider the effects of the injury as they continue to develop.;
- Any compensation agreed between the parties should be approved by a Judge before the claim can be concluded;
- The compensation will normally be paid into a Trust Fund held for the benefit of the child.
