Claiming for Mesothelioma
Mesothelioma (which is commonly referred to as ‘meso’) is a form of cancer that affects the cells that line many of our body’s organs. It is almost always caused through exposure to asbestos dust. Unlike other types of asbestos related conditions, you do not need to experience heavy or prolonged exposure to asbestos to develop mesothelioma. Relatively light exposure to asbestos fibres and dust significantly increases the risk of developing mesothelioma.
People who have not worked directly with or in close proximity to asbestos are also at risk of developing mesothelioma, such as people who have lived with someone who has worked with asbestos and travelled home with asbestos fibres and dust still present on their clothing, or who has lived near an asbestos factory.
At the time of diagnosis you may not be able to recall any past exposure to asbestos, however it often helps to speak with a specialist solicitor who has the experience and industry knowledge to assist in piecing together your past asbestos exposure.
Due to the long passage of time, your old employer may no longer be in business or trading under the same name. The building where you were exposed may have even been demolished. This is not uncommon in these types of claims and our specialist team of solicitors will carry out all the necessary steps to find the organisation responsible for your exposure and their insurer.
Finally, for your claim to be successful we will then need to show that the employer or organisation who exposed you to asbestos should have been aware of the risks of injury arising from the exposure, to the extent that they should have offered protection or advised you of the dangers.
There are a lot of statutory regulations and case law which impose different standards on employers and organisations depending on the date when the exposure(s) occurred, the type of exposure and the industry responsible for exposing you. Even if you were exposed more than 50 years ago or you are not even sure how you were exposed to asbestos, it is worth contacting one of our specialist asbestos solicitors who will be able to talk you through the likelihood of making a successful claim.
