Chronic Pain Compensation Claims

In medical terms chronic pain is defined as significant symptoms which continue beyond the expected period of healing.

There may be a number of different reasons why an individual will experience chronic pain following an injury. In addition the cause of the chronic pain may be relatively easy to identify such as nerve root irritation following a back injury, or it may be more complex in nature and may even have a psychological component.

There are a number of conditions which give rise to significant and persisting chronic pain but which are not easily explained from a medical perspective. These include Complex Regional Pain Syndrome (also known as Reflex Sympathetic Dystrophy), Chronic pain syndrome and Fibromyalgia.

Expert medical evidence will be required in order to identify the nature of the chronic pain and the likely cause. This may be amenable to treatment and may require referral to a pain management clinic as well as prescribed medication and possible psychological intervention.

Referral to a pain management programme (PMP) may also assist. Attending a pain management programme can help to reduce the disability and distress caused by chronic pain by teaching physical, psychological and practical techniques to improve quality of life. There are also a number of voluntary organisations and self-help groups who can provide practical advice and assistance including the British Pain Society, the Chronic Pain Support Group and Pain Concern.

Where treatment does not reduce or eliminate symptoms of chronic pain, the long term effects can be extremely disabling. Accordingly the question of chronic pain needs to be fully investigated to ensure that maximum compensation is recovered.
