Children Cyclist Road Traffic Accident Compensation Claims
All motorists have a duty of care towards other road users including child cyclists. As a consequence should an accident occur due the actions of another driver, you may be able to pursue a claim for personal injury compensation.
According to the Royal Society for the Prevention of Accidents (ROSPA) about one-third of cycling accidents involve children. This remains the case despite the fact that drivers are expected to be especially careful when driving near a child cyclist. This is because the law recognises that a child may not have the same level of competency on a bicycle as an adult or have the same degree of awareness.
The vast majority of cycling accidents involving children occur when they are struck by a motor vehicle. This will usually occur because the driver fails to see the cyclist when they are pulling out in to a road or turning. Having said this, a personal injury claim may even be possible where no collision has occurred, for example where the driver is too close to a cyclist or changes lanes quickly causing them to swerve or lose balance.
At Sintons we have a wealth of experience in pursuing claims for children who have sustained injury on the roads.
All personal injury claims are pursued on a No Win No Fee basis so you can rest assured that there is no financial risk.
