What is the time limit for making an Inheritance Act claim?

If you wish to bring an Inheritance Act claim it must be issued at court within 6 months of the grant of probate (or the grant of letters of administration) in the deceased’s estate.

It is important to take legal advice in advance of this time limit (if possible) as you may need to prepare the claim for issue at court and should engage with the other parties before this.

It is possible to bring a claim outside of this 6 month time limit using Section 4 of the Inheritance Act. You will need to explain to the court the reasons for the delay and obtain the court’s permission. We can assist you with making such an application if necessary.
