Indemnity and policy coverage disputes are frequent issues, which take on particular significance in high value claims.

In addition to advising on the interpretation of policy terms, we have extensive expertise of advising motor insurers on their obligations as statutory insurer pursuant to the Road Traffic Act 1988, and in relation to insurers acting pursuant to Article 75 of the Articles of Association of the Motor Insurers Bureau.

We are frequently instructed by insurers to assist with indemnity investigations following notification of claims, and we have significant experience in obtaining declarations for insurers for the purposes of section 152 of the Road Traffic Act 1988.

Advice regularly includes consideration of the impact of other relevant legislation, including the Consumer Insurance (Disclosure and Representations) Act 2012 and Deregulation Act 2015.
