Catastrophic injury

We understand that the most complex injury claims, involving individuals who have suffered life-changing catastrophic injuries, form a major component of the total spend of our insurer clients.

Our specialist team of catastrophic injury lawyers, headed by partner Jamie McCabe, deals solely with these claims, and is nationally recognised for expertise in this complex area of litigation.

We have been appointed to specialist panels by many major UK motor insurers, to deal with their most complex catastrophic claims, which usually have a value between £1 million and £20 million.

We are frequently instructed at an early stage to help with the investigation of claims, and we adopt a pro-active approach to handling claims, with the aim of achieving pragmatic, cost-effective resolution of claims at an early stage, to reduce total spend.

We routinely consider alternative dispute resolution (ADR) as part of a strategic approach to engage with opponents and explore opportunities to conclude claims.

We recognise the importance of a team-based approach, and we work closely with our clients to resolve claims together. We frequently assist with the selection of counsel, and have long standing relationships with a range of experienced medical and non-medical experts.

Our expertise in this area includes advising on the following issues:

  • life expectancy;
  • mental capacity;
  • provisional damages awards;
  • periodical payment orders (PPOs); &
  • the interplay between statutory and private funding for care and rehabilitation.

We also have considerable experience in dealing with catastrophic claims from injured parties based outside the UK or of dubious immigration status requiring interaction with the Home Office and UK Border Agency; recent examples include cases involving parties in North America and Asia.
