Objection to the registration of a Power of Attorney


A lasting power of attorney must be registered before it can be used by the attorney or attorneys. The application to register can be made by the donor of the power or an attorney.

An enduring power of attorney must be registered when the attorney believes the donor of the power is becoming mentally incapable of managing their own financial affairs.

The process of registration is different for lasting powers of attorney and for enduring powers of attorney. We would be happy to advise you about this.

It is possible for certain categories of people to object to the registration of an enduring or lasting power of attorney. You may wish to object to the registration of a power of attorney on the grounds that it is not a valid document, it has been revoked, fraud or undue pressure was placed on the donor to make it, or that the attorney proposes to act in a way that would not be in the donor’s best interests.
