Withdrawal of life-sustaining treatment
Where a patient lacks capacity to consent to medical treatment, disagreements will sometimes arise between treating medical professionals and family members about whether a particular treatment is in a patient’s best interests. Where that disagreement relates to the provision, continuation or withdrawal of life-sustaining treatment the treating NHS Trust should refer the decision to the Court of Protection if that disagreement cannot be resolved through mediation
Our Court of Protection team can support families in mediating with medical professionals where withdrawal or withholding of life sustaining treatment is proposed. Out specialist lawyers can advise on the legal process for challenging such decisions and provide representation in Court of Protection proceedings.
